Do you need a visa to visit Canada?
What you need to visit Canada depends on several parameters:
-the type of travel document with which you will travel;
-the country in which your travel document was delivered;
-the type of transportation you will use to reach Canada.
Who needs an electronic travel authorization (eTA) to enter Canada?
You will need an eTA if:
-you are a foreigner exempted from getting a visa and you enter Canada by plane of transfer through a Canadion airport.
-you are a legitimate permanent resident of the United States and you enter Canada by plane of transfer through a Canadion airport.
How do I find out whether I need to apply for an eTA or a visa to enter Canada?
The requirements vary depending on your country of origin, your means of transportation you chose and your travel documents. Please check the official list to determine the admission requirement by country or territory here:
I am a business visitor. Do I need a permit to work in Canada?
You don't need a working permit to perform commercial activities related to your work in your country of origin, such as meeting your company's clients or visiting workplaces.
However, you will need to apply for a working permit if you perform activities related to management, accounting, production or technical activities. In the event of a visit lasting over 6 months, a working permit will be necessary as well.
I am going to perform perform activities related to management, accounting, production or technical activities, or I will stay for over 6 months in Canada. Do I need a permit to stay in Canada?
Moreover, if you come from a country where people need a visa to visit Canada, you will need to apply for a temporary residence visa or an eTA.
Do you have other examples of commercial activities that do not require to obtain a working permit? (1/2)
- Participating in business meetings, conferences, congresses, fairs, ect…
- Making an order of goods or services;
- Providing customer service, except in the case of the construction industry;
- Training by a Canadian parent company in preparation of work outside of Canada;
- Training the employees of a Canadian branch company of a foreign business.
Do I need to prove that I perform this type of activity? (2/2)
Commercial visitors need to demonstrate that:
- They plan to stay in Canada for a short time only, usually less than six months;
- They don't plan to intergrate the Canadian labour market in any way;
- They main workplace and source of revenue are located outside of Canada;
- And they meet the criteria required to enter Canada.
I am going to enter Canada to provide an after-sale service. Do I have the obligation to get a working permit?
In general no, if the after-sale service is performed within the scope of the original contract, the extended sales contract, the rental purchase agreement, the guarantee or the contract of service. However, even if it isn't stipulated in the agreement, there are some ctivities that cannot be performed in Canada by a foreign business traveller such as:
- Operating on equipment, machines or production softwares;
- Activities of installation, that is to say manually setting up in the construction or building sectors.
What do I need to do to hire a foreign temporary worker?
The hiring process of a foreign temporary worker includes 3 steps:
- Obtain a LMIA (Labour Market Impact Assessment) or submit a job offer;
- Instruct the worker to apply for a working permit;
- Inform the worker of what will happen next.
What is the Temporary Foreign Worker Program?
In order to assess whether or not you can hire a foreign worker to put an end to a shortage of employees or skills on a temporary basis, you will need to apply for a Labour Market Impact Assessment (LMIA). You will then be able to choose from various specific options depending on the applicant's profile and the situation.
